Final Delegated Acts Adopted by European Commission

The Delegated Acts on Verification and Accreditation of Verifiers and on Monitoring Methods pursuant to EU MRV Regulation 2015/757 were adopted on 22.09.2016 following a 4-week public consultation over the summer. The Implementing Acts on Emissions Templates and on Cargo Carried are expected to come into force before the end of 2016. 

The final Delegated Acts adopted by European Commission are:
 

Final Delegated Act on Verification and Accreditation
 

The backbone of the MRV shipping Regulation is ‘per ship’ reporting of aggregated annual data satisfactorily verified by an accredited third party. As set out by the European Commission, Verifiers are required to:
 
  • assess monitoring plans, as submitted by companies, for conformity with the MRV Regulation and this Regulation;
  • verify that no annual aggregated data on CO2 emissions or other relevant information in the ship’s emissions report are materially misstated;
  • issue, and send to the company, a verification report that includes a statement indicating whether or not the emissions report is satisfactory and setting out the main issues identified during the verification process; and
  • inform the Commission and the ship’s flag state that the conditions for issuing a document of compliance have been fulfilled, once the company has submitted an emissions report that has been verified as satisfactory.

Final Delegated Act on Monitoring Methods

 
The Delegated Regulation is intended to update Annexes I and II to Regulation (EU) 2015/757 by considering relevant international standards and rules and scientific and technical developments as set out by the European Commission:
 
  • it lays down the emission factors to be used to determine CO2 emission as set at international level in the IMO in Resolution MEPC 245 (66) 2014: Guidelines on the method of calculation of the attained Energy Efficiency Design Index (EEDI) for new ships;
  • it adds the possibility for companies using fuel monitoring methods A and C to determine actual density on the basis of the density measured by an accredited fuel test laboratory in line with ISO 3675:1998;
  • it requires ‘time spent at sea’ and ‘distance travelled’ under Annex II, section A, points (a) and (b) to be calculated on a ‘berth-to-berth’ basis in line with relevant international expert recommendations;
  • it provides for the actual mass of cargo to be used as an additional option to determine cargo weight for ro-ro ships under point (e) of paragraph 1 of Part A of Annex II to Regulation (EU) 2015/757, as provided for in the IMO Guidelines for voluntary use of the ship Energy Efficiency Operational Indicator (EEOI) and EN 16258 (2012).
